These Terms of Use (“Terms”) govern your use of the PassageMail websites, PassageMail Weather for iOS and Android, PassageMail Blog, and the PassageMail Thunderbird extension (collectively, the “Service”), operated by PCN, LLC (“PassageMail,” “we,” “us,” or “our”).

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PassageMail is an email and marine-weather service designed for use over low-bandwidth connections, including satellite links. Features include an @passagemail.com mailbox, weather chart delivery, voyage tools, and (if subscribed) a PassageMail Blog site.

2. Accounts

You are responsible for keeping your account credentials confidential and for activity under your account. You must provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk to other users or to our infrastructure.

3. Subscriptions, Billing, Refunds

Paid plans (Weather, Blog, bundles) renew automatically until canceled. You can cancel at any time from your account page or the respective app store. Fees already paid for the current billing period are generally non-refundable except where required by law or by the store from which you purchased. Mobile in-app purchases are handled by Apple or Google under their respective terms; web purchases are handled by Stripe.

PassageMail Weather may offer a 7-day free trial. If you cancel during the trial, or do not purchase at the end of the trial, service ends when the 7-day trial ends and your account and all its data are permanently deleted 3 days after that (day 10). The retired @passagemail.com email address is locked and cannot be reissued. The 30-day and 90-day retention windows described below apply to paid subscriptions only, not to unconverted trials.

4. Account Deletion

You may request account deletion from inside the apps or from the web deletion page. There are two modes:

  • Schedule Deletion. If you have an active paid Weather subscription, deletion takes effect 30 days after your paid period ends. If you have no active subscription, deletion takes effect 30 days after your request. Your account keeps working during this window, and you can cancel the request from inside the app before it takes effect.
  • Delete Now. Requires a second confirmation and removes the account immediately after it completes; it cannot be reversed.
  • Unconverted 7-day free trial. See the trial rule in Section 3 — not covered by the 30-day window.

When deletion takes effect we remove the account’s mailbox, mail content, calendar, contacts, settings backups, device bindings, Blog content, and voyage tracker positions from the live service, subject to the retention periods described in the Privacy Policy. Backup copies may remain for up to 90 days. Deleting a PassageMail account does not cancel an Apple or Google subscription.

5. PassageMail Blog

If you subscribe to PassageMail Blog, we host a WordPress site at blog.passagemail.com/<your-slug>/. You own what you publish.

When your Blog subscription is cancelled or expires, your blog remains viewable (read-only) for 90 days from cancellation or expiry; after that it is permanently deleted. You can renew during the 90-day window to resume posting. If you cancel your PassageMail Weather subscription while your Blog subscription is still active, your blog goes into read-only mode (no new posts or edits) but remains viewable until the Blog subscription itself ends — plus the 90-day read-only grace that follows. You can delete individual posts, or your entire blog site, immediately via the delete option; Blog content is also removed when your requested account deletion takes effect.

6. Acceptable Use

You agree not to use the Service to:

  • (a) Illegal content and conduct. Post, publish, store, transmit, or link to content that violates US federal, state, or local law, or any applicable law of your jurisdiction. This includes but is not limited to child sexual abuse material (CSAM), content that sexually exploits a minor, content that depicts or incites violence against identifiable persons or groups, controlled-substance transactions prohibited by law, firearms transactions prohibited by law, false identification documents, and content advertising or facilitating human trafficking.
  • (b) CSAM. Child sexual abuse material (CSAM) is absolutely prohibited, in any form. We proactively scan uploaded images against known-CSAM hash databases (via Cloudflare’s CSAM Scanning Tool), report apparent CSAM to the National Center for Missing & Exploited Children CyberTipline as required by 18 U.S.C. § 2258A, preserve related data pursuant to law, and permanently terminate the responsible account.
  • (c) Harassment, hate, threats. Publish or send content that targets another person or protected class with harassment, abuse, intimidation, stalking, doxxing, revenge pornography, non-consensual intimate imagery, or incitement to violence. Content that harasses, threatens, or incites hatred or violence against people on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age is prohibited.
  • (d) Spam, phishing, scams. Send unsolicited bulk email, chain letters, mass marketing, or messages designed to deceive the recipient (phishing, pretexting, impersonation of a brand or individual, deceptive investment or crypto schemes).
  • (e) Malware, exploits, abuse. Distribute malware, ransomware, worms, viruses, trojans, keyloggers, cryptominers, or any code designed to damage or gain unauthorized access to systems. Scan for or exploit vulnerabilities on PassageMail infrastructure or on third parties through PassageMail infrastructure.
  • (f) IP infringement. Publish, store, or transmit content that infringes copyright, trademark, trade secret, right of publicity, or other intellectual property rights. See our DMCA Policy at /copyright/ for notice-and-takedown.
  • (g) Platform abuse. Interfere with the Service, bypass security measures, circumvent rate limits, or use PassageMail to launch denial-of-service or amplification attacks. Abuse the FTPmail or chart-request subsystem (we may rate-limit, filter, or block abusive patterns, and your batches may be filtered before submission to NOAA).
  • (h) Impersonation / identity fraud. Falsely claim affiliation with PassageMail, PCN LLC, another person, business, or government entity. Falsely represent your identity to open an account.
  • (i) Sanctions evasion. Use PassageMail to transact with persons or in jurisdictions subject to US sanctions. Access may be geo-blocked from comprehensively-sanctioned jurisdictions.

6a. Enforcement

We investigate reports of violations and may, at our sole discretion:

  • Remove or disable specific content.
  • Unpublish a blog post or disable a blog site.
  • Suspend an account’s access while we investigate.
  • Terminate an account for violations of these Terms, repeat IP infringement (consistent with our DMCA Repeat-Infringer Policy at /copyright/), or where we are required to by law. Terminated accounts’ PassageMail Blog site and content are permanently deleted, Weather and Blog subscriptions are revoked without refund, and the retired @passagemail.com email address is locked and cannot be reissued.
  • Report apparent CSAM to NCMEC and apparent other-crime material to appropriate law enforcement, as required by law.
  • Preserve account data pursuant to a valid legal preservation request, overriding the normal retention / deletion schedule.

We generally notify the affected account owner of enforcement action except where notification would compromise an investigation, violate a legal gag order, or risk harm. Our Privacy Policy describes how long preserved data is retained.

Suspended or terminated accounts have no refund right for fees already paid for the current billing period. Account holders may appeal enforcement decisions by writing to [email protected]; we review appeals in good faith but reserve final discretion.

Reports. To report content you believe violates these Terms, use the “Report this blog” or “Report this post” link in the blog footer, or email [email protected]. Please include the specific URL, a description of the violation, and your contact email.

7. Weather Information Disclaimer

Weather charts and forecasts delivered by the Service come from the United States National Weather Service and other public sources. Marine weather can change rapidly. The Service is a planning aid, not a substitute for official NOAA warnings, local observations, trained judgment, or life-safety equipment. Use at your own risk.

8. Satellite and Carrier Access

Use of the Service over a satellite link requires compatible hardware and your own airtime contract with the satellite carrier (for example, Iridium). You are responsible for carrier fees. We do not guarantee availability of any specific carrier or hardware integration.

9. Intellectual Property

The Service, including its software, text, images, and trademarks, is owned by PCN, LLC and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for your personal or small-business maritime communications. You may not copy, modify, reverse engineer, or redistribute the Service except as expressly permitted by law.

10. Third-Party Services

The Service integrates with third parties (including Apple, Google, Stripe, FluentCart, Nelio, and the NOAA FTPmail/NWS systems). Those services are governed by their own terms, which apply when you interact with them.

11. Disclaimers

The Service is provided “as is” and “as available.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, or error-free operation. Features and content may change at any time.

12. Limitation of Liability

To the maximum extent permitted by law, PassageMail, PCN LLC, and our officers, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless PassageMail and PCN, LLC against any claim or demand arising from your use of the Service, your content, or your violation of these Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your account for violation of these Terms, non-payment, prolonged inactivity, or legal requirement. Sections 7 through 13 and 15 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated “Last Updated” date; continued use of the Service after the change constitutes acceptance.
