PCN, LLC (“PassageMail”) respects the intellectual property rights of others and expects users of the PassageMail Service (including PassageMail Blog) to do the same. We respond to notices of alleged copyright infringement that comply with the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

DMCA Designated Agent registration: PCN LLC has filed its DMCA Designated Agent registration with the US Copyright Office (registration number DMCA-1081914). Payment is processing. The registration becomes publicly listed in the Copyright Office directory on verification; until then, DMCA notices should be sent to the Designated Agent at the contact information below.

1. Sending a DMCA Notice (Takedown)

If you believe content hosted on a PassageMail property infringes a copyright you own or are authorized to represent, send a written notice containing all of the following to our Designated Agent:

  1. A physical or electronic signature of a person authorized to act for the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works at a single site).
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it — typically the exact URL(s) on blog.passagemail.com or passagemail.net.
  4. Your contact information (name, mailing address, telephone, email).
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

2. Counter-Notice

If you believe your material was removed or disabled by mistake or misidentification, you may send a counter-notice containing all of the following to our Designated Agent:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which PCN LLC may be found), and that you will accept service of process from the person who provided notification under paragraph (c)(1)(C) of 17 U.S.C. § 512 or an agent of such person.

On receipt of a valid counter-notice we will forward it to the original complainant. Unless the complainant files a court action within 10 business days, we may restore the removed material.

3. Repeat-Infringer Policy

Consistent with 17 U.S.C. § 512(i), PCN LLC maintains a policy to terminate, in appropriate circumstances, the accounts of repeat infringers. An account is subject to termination after the third valid DMCA takedown involving separate works, or sooner where the conduct warrants.

Termination means permanent deletion of the account's PassageMail Blog site and content, revocation of the account's Weather and Blog subscriptions without refund, and permanent lock of the retired @passagemail.com address so it cannot be reissued.

4. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that it was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner or authorized licensee, or by PCN LLC.

6. Renewal

DMCA Designated Agent registrations with the US Copyright Office must be renewed every three years (37 CFR § 201.38). PCN LLC's next renewal is due by October 2029.
